1. Eligibility

FlightApex is intended for aviation professionals and recreational users, including pilots, aircraft owners, flight schools, clubs, instructors, maintainers, and aviation enthusiasts. You must be at least 18 years old and legally capable of entering into binding contracts to use the Platform.

2. Platform Features

FlightApex offers a comprehensive suite of aviation tools and services, including:

• User accounts with FAA/DOT certificate details, contact info, and profile photos
• Aircraft tracking, expense logging, maintenance records, and document storage
• Pilot and AMT logbooks with export options (e.g., FAA Form 8710 mockups)
• Flight scheduling and instructor booking
• Real-time weather center with alerts and planning tools
• Flight computer for calculations and weight/balance
• Flight planning with navigation and regulatory overlays
• FAA handbooks and aviation library
• FARs browser with searchable CFR regulations
• Aviation news aggregation
• Group management for clubs, schools, and shared aircraft
• Social media features including posts, followers, and direct messaging
• Flight training collaboration tools
• Peer-to-peer marketplace for items and services

We may add, modify, or remove features at our discretion.

3. Account Registration and Responsibilities

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You agree not to share your account or impersonate others.
• You are responsible for all activity conducted through your account.

4. Prohibited Conduct

You agree not to:

• Use the Platform for illegal, fraudulent, or unauthorized purposes
• Post or share content that is defamatory, obscene, abusive, or violates intellectual property rights
• Attempt to hack, disrupt, or reverse-engineer any part of the Platform
• Use bots, scrapers, or automated systems to access or interact with the Platform
• Harass, threaten, or exploit other users

5. User-Generated Content

You retain ownership of any content you post, upload, or share on FlightApex, including text, images, videos, logbook entries, aircraft data, and marketplace listings ("User Content").

By submitting User Content, you grant FlightApex a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, publicly perform, and publicly display such content:

• Within the Platform and its features
• In promotional materials, advertisements, and marketing campaigns
• On FlightApex's social media accounts and external communication channels
• In educational or community-building initiatives

This license includes the right to feature your content in screenshots, testimonials, product showcases, and other media formats, with attribution where appropriate. We will not sell your content to third parties or use it in misleading contexts.

You represent and warrant that you have the rights to grant this license and that your content does not infringe on the rights of others.

6. Marketplace Transactions

• FlightApex provides a peer-to-peer marketplace for aviation-related items and services.
• We are not a party to transactions and do not guarantee the quality, legality, or delivery of listed items.
• Users must comply with applicable laws and regulations when engaging in commerce.
• Payments may be processed directly or through third-party services. FlightApex is not responsible for disputes between buyers and sellers.

7. Payments and Billing

• Payments for rentals, instruction, or group services are processed via integrated or third-party systems.
• You agree to pay all applicable fees and taxes.
• Refunds and cancellations are subject to the policies of the service provider, seller, or group administrator.

8. Training and Educational Content

• FlightApex offers access to training materials, FAA handbooks, and collaborative tools for student progress.
• These materials are for informational purposes only and do not replace certified instruction or regulatory compliance.

9. Intellectual Property

All FlightApex branding, software, original content, and proprietary features (excluding user-generated content and public domain materials) are owned by us or our licensors. This includes our logos, interface design, proprietary databases, and custom tools.

FlightApex may include or republish publicly available or government-supplied content, such as aviation regulations, weather data, and FAA publications. These materials remain under their original licenses or in the public domain and are not claimed as proprietary by FlightApex.

You may not copy, modify, distribute, or reverse-engineer any part of the Platform except as expressly permitted by law or by written permission from FlightApex.

10. Data and Privacy

FlightApex collects and stores personal and usage data, including FAA/DOT certificates, contact info, logbook entries, aircraft data, and platform interactions.

By using the Platform, you consent to our use of this data for:

• Improving platform functionality and user experience
• Aggregated analytics and operational insights
• Marketing, promotional, and advertising purposes
• Sharing with trusted third-party partners for commercial or operational collaboration
• Monetization through anonymized or pseudonymized data sets

We may use your data to personalize content, analyze trends, and support aviation research.

11. Termination

We may suspend or terminate your account at any time for violations of these Terms or other misconduct. You may also delete your account at any time.

12. Platform Status and Beta Disclaimer

FlightApex is currently under active development and may be offered in a beta or pre-release state. You acknowledge and agree that:

• Not all features may be available at all times
• Some features may not function as intended or may be temporarily disabled
• Updates, maintenance, or technical issues may cause interruptions or data inconsistencies
• You use the Platform at your own risk, and FlightApex is not liable for any loss, damage, or inconvenience resulting from incomplete, inaccurate, or unavailable functionality

We appreciate your feedback and patience as we continue to improve the Platform.

13. Arbitration and Dispute Resolution

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or your use of FlightApex shall be resolved exclusively through final and binding arbitration, rather than in court.

Arbitration Process: Arbitration shall be conducted by a single arbitrator under the rules of the American Arbitration Association (AAA), or another mutually agreed-upon arbitration provider. The arbitration shall take place in Seminole County, Florida.

Waiver of Class Actions: You and FlightApex agree to resolve disputes individually and not as part of any class, consolidated, or representative action. The arbitrator may not consolidate claims or preside over any form of representative or class proceeding.

Governing Law: This agreement and any arbitration shall be governed by the laws of the State of Florida, without regard to its conflict of law principles.

14. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting an update on the Platform or contacting you directly. Your continued use of FlightApex after the Effective Date of any changes constitutes your acceptance of the revised Terms.
